Answer to Question 1

In a group I facilitate we have recently had a problem with a member who had been accused of taking too much money off of people while organising an outing. The problem was that there was no proof, which meant that I was put in a position of having to protect the rights of not only the person, but also the members that accused him. Taking money off of people, especially the more vulnerable members is against the rules of the group and if guilty he must be removed from the group.

Answer to Question 2

Service user K has the right to attend the group and the group is an important part of his life, removing him from the group if he was innocent would be unfair.

Service user M has the right not to be conned out of her money and also not to feel intimidated by K.

Answer to Question 3

Service user K would lose the right to attend the group if either something had been proved about last time or if he did that sort of thing again.

Service user M feels intimidated by K and although she would have the right to still attend the group, she may stop coming because of the situation.

Answer to Question 4

Service user K: I have twice now requested to chat in private with him, explained the situation and what he has been accused of. To protect his privacy in case he is innocent the meetings have been explained to everybody as discussions about photography (a shared interest we both have). To protect the rights of M and the other members of the group he has been asked via letter from the steering group to stay away from the group until the money has been paid back. I have also told him that if he wants to fight the ban from the group I will go with him to meet with S (the person who has the final decision about his membership of the group) to give him moral support.

Service user M: I am monitoring the situation and trying to keep an eye on her, so that nobody can get money out of her that she does not owe. The problem is with M that she has no concept of money, for example once while we were on a trip together she asked if she had enough money to buy a £3 ornament and showed the contents of her purse, which contained at least £50. She may have given K too much money, but it's hard to prove when she has so little understanding of money. Any shop she went to could have seriously overcharged her and she would probably not know.
