As the full terms and conditions were rather long I have created a simple list with the basics, please read at least these 5 things before you use the content of my site for anything:
1. Do not use my stuff for anything profit making without my permission, so no selling it on eBay as somebody recently tried! I will find out!!!
2. If you are going to use my stuff on a web site please feel free, but make sure I get credit for it and a link to my site if possible (tell me and I will probably link back to you)
3. I am happy for you to use my stuff, but do not just rip off my content i.e. I am happy for you to use a photo of Hastings to show where you used to go on holiday (or whatever), but do not create a page about Hastings and base it all around my photos unless you get permission from me first.
4. Please do not directly link to my content, I have to pay for most of the bandwidth / data transfer that gets used, so if you want to use a photo (or whatever) please upload it to your own webspace. I do rename files from time to time to stop people linking to them and if you do then your site will break when that happends!
5. If you want to use any content for a magazine or leaflet then the main thing I will ask for will be a couple of copies of it, I do not ask big fees, but donations towards the upkeep of the site are always VERY welcome.

2.1 This Site and the materials, products and services in this Site are provided on an "as is" and "as available" basis.
2.2 To the full extent permitted at law Aspex Design makes no (and expressly disclaims all) representations or warranties, express or implied in respect of this web site or its contents or the contents, advice and opinions of any Hypertext Link or third party contributor to this Site, including, but not limited to, implied warranties as to quality, accuracy, adequacy, usefulness, timeliness, reliability, merchantability and fitness for a particular purpose and non infringement of the contents of this Site or any goods or services purchased or obtained or any transactions entered into by you through this Site.
2.3 Aspex Design does not represent or warrant that the material or any of the functions contained in this Site or the contents of any hypertext link or any comments, advice or opinions by any third party contributor to this Site will be uninterrupted, accurate, complete or that current defects will be corrected, or that this Site or the server that makes the Site available are free of viruses or other harmful components, but I always do scan files with an up to date virus checker.
3 Copyright notice
3.1 You agree that all copyright, trademarks and other intellectual property rights in the material or content of this Site shall remain at all times vested in Aspex Design or its licensors.
3.2 You agree that the content of this Site is made available for you in your personal capacity and for your personal use only, and not for any commercial use without written permission.
3.3 You agree that you will not change in any way any proprietary notices from material downloaded from this Site by you for your non commercial personal use.
3.4 All contents of this site may be used on compilation CD's or magazine cover CD's on the condition that I am told before hand and I a supplied with a copy of the item, if not it will be considered as illegal infringement and in breach of this sites terms of use guidelines.
3.5 You may not upload any collection of the files from this site to your own without permission from me in advance i.e. use of my frames on your site to create your own images is perfectly acceptable, but you may not create a page of my frames to download.
3.6 If you do get permission then you must make sure that it is clear that the files were created by me and that they are copyright of Aspex Design somewhere on your site.
3.7 A reciprocal link to www.aspexdesign.co.uk would be apprciated on each page that content from this site is used, if you do not add a link I will probably never find out, but please at least think about it. A link to my site costs you nothing and if you tell me then I will probably even link to your site in return.
4 Trademarks
4.1 The trade marks and logos and service marks used and displayed on this Site are, unless otherwise specified, the trademarks of Aspex Design. No rights are granted to use any of them without the written permission of Aspex Design.
4.2 All film, game and TV program titles are copyright of their respective creators and no infringement of copyright is intended, all rights reserved. Any company not wanting the free publicity of being listed on the site may contact me and I will remove the titles straight away.
5 Limitation of Liability
5.1 With the exception of death or personal injury resulting from the negligence of Aspex Design and to the fullest extent permitted by law you agree that Aspex Design shall not be liable in negligence, contract, tort, statutory duty or in any other way for any of the following:
5.1.1 Any loss or damage caused of whatever nature arising directly or indirectly from or in any way related with the Site, or
5.1.2 your reliance or use of any information or material obtained either directly or indirectly from the use of this Site, or
5.1.3 any other consequential or pecuniary loss in any way related to the use of this Site.
5.2 You agree that it is your sole responsibility to evaluate any services offered by this Site or by any third parties via this Site.

6.1 Aspex Design may provide a link from its own Site to other web sites, however you agree that Aspex Design has no control over these Hypertext Links (or any other third party link) and that you use these links entirely at your own risk.
6.2 You agree that Aspex Design has no responsibility or liability for the content or any policies of any Hypertext Links (or any other third party link) as mentioned in 6.1 above.

You agree to keep Aspex Design indemnified against all actions, claims, costs, expenses (including all legal costs) and damages brought against or suffered by Aspex Design arising out of any breach of these terms and conditions or any activity relating to your use of the Site (including negligent or wrongful conduct) by you or any other person accessing the Site using your name or any other name with which you have registered under this Site.
8 Persons under the age of 18
8.1 If you are under 18 years of age you agree that you have had your parents permission to send any information to me about yourself or anyone else over the Internet.
8.2 Aspex Design make no representations or warranties to the effect that the contents of this Site are suitable for people under the age of 18.
8.3 Under 18's may use this site, but they do so at their own risk.
8.4 There are two pages with content that may not be suitable for young children, those pages do have warnings on them and it is up to the visitor if they want to continue to read those pages.

12 Cookies
Cookies are a small piece of information that are stored by your browser on your computer's hard drive. Aspex Design do not use cookies on the Site, but the third party counters etc. may use them as they are out of my control.
13 E-Mail
Please note there is no guarantee that any e-mail sent will be received by me, or that the contents of any such e-mail will remain private during internet transmission. If you have any such concerns, you may prefer to telephone or write to us instead. I will always try to answer e-mails, but due to work and college commitments it may take up to 14 days. If you have not received a reply within 14 days please contact me again as the message may have been lost or accidentally deleted by my spam filters.
14 Data Protection
If you choose to contact me by e-mail, the personal information you provide will be used by Aspex Design to enable me to answer your queries and to provide you with information about the services that are of interest to you. You have the right under the Data Protection Act to request a copy of the personal data which I hold with reference to you on my computer system.
15 Bandwidth Stealing
It is imperative that you do not link to any of my images on any of my pages. I have enough problems with bandwidth without a thousand people linking off my server as well, so please right click and click save image as to save to your hard drive. To help prevent this I do change the file names from time to time and this will break this links from your sites, so if you want your sites to work make sure you never link directly to any file on this site.
